SUBLETTE COUNTY \u2013 A man who \u201cinvested\u201d at least $110,000 in a Big Piney landscaping business and expected to be repaid in March with percentages of gross income from completed jobs filed a civil suit in 9th District Court seeking repayment.<\/p>\n

The civil suit alleges Shane R. Copeland and Ramsey Copeland, owners of Triple Peak Landscaping, LLC, breached two handwritten contracts and received \u201cunjust enrichment\u201d after \u201csilent investor\u201d William F. Murdock presented Shane Copeland with two amounts \u2013 one of $30,000 and one of $80,000 \u2013 on Oct. 26, 2021.<\/p>\n

Each contract specifies that \u201cthis investment will be put forth as capital towards the companies (sic) ultimate goal to work year round and expand our field of work. Triple Peak Landscaping LLC and Bill Murdock are working together to achieve the ultimate goal of ‘constant cash flow.’ The turn around on this investment will be astronomical.\u201d<\/p>\n

Breach of contract<\/strong><\/p>\n

Both \u201cinitial investments\u201d would be repaid \u201cno later than 3\/26\/22 by Triple Peak!,\u201d according to copies of the contracts filed with the civil lawsuit.<\/p>\n

The $30,000 “initial investment” would have a 4-percent “return rate on the gross of every job completed” to Murdock; Copeland committed to making monthly copies \u201cof all projects completed,\u201d it says. The $80,000 investment would have a \u201c9-percent return rate on the gross income of every job completed,\u201d the suit says.<\/p>\n

Murdock’s payments would be included with each monthly report, it says.<\/p>\n

Through June 15 of this year, Murdock also provided \u201cadditional monies by checks to defendants\u201d for a total of at least $143,000, the suit says.<\/p>\n

\u201cAs of the filling of this complaint (July 21), no payments have been received by (Murdock) from the (Copeland) nor have the defendants provided (Murdock) with documents regarding completed projects, percentages of gross income from projects completed by Triple Peak Landscaping LLC or any return on his investments,\u201d the suit alleges.<\/p>\n

Damages sought for breach of contract are no less than $143,000 and to be determined at trial, it says. Murdock is represented by attorney Travis Bing of Pinedale.<\/p>\n

Unjust enrichment<\/strong><\/p>\n

\u201cUpon information and belief, (Copelands) have received a substantial financial benefit at the expense of (Murdock) without repayment, according to the suit’s second count.<\/p>\n

“Unjust enrichment” is a general principle that one person should not enrich himself at the expense of another and restitution should be made, it explains.<\/p>\n

The lawsuit outlines four elements of unjust enrichment that must be proven for the one seeking damages that includes a party accepting and enjoying \u201cvaluable services or materials\u201d without making repayments.<\/p>\n

\u201cDefendants presumably used the plaintiff’s investment deposits in order to expand their landscaping business, reap a monetary gain and or to enrich themselves \u2026 without repayment for the monetary benefits acquired,\u201d the complaint says.<\/p>\n

It seeks prejudgment and post-judgment interest on Murdock’s damages, payment of his attorney and court costs and any other \u201cjust and equitable\u201d relief.<\/p>\n

Shane and Ramsey Copeland and Triple Peak Landscaping \u201cadmit\u201d in their Aug. 17 response that they executed a contract for $80,000 and $30,000 investments and signed documents were made to create a legally binding contract.<\/p>\n

All other allegations are denied and they ask for the complaint to be dismissed. They are represented by attorney Clark Stitch of Rock Springs.<\/p>\n
